The extensive reach of the false data from 101i and 101d led to inaccurate earnings and loss statements gathered from 16 witnesses. The false data generated from 101i and incorporated into 101j and 101d was used during the direct examination of nine government distributor witnesses and three defense distributor witnesses. Additionally, this false data resulted in particularly egregious and impactful testimonies from four key government witnesses who held elevated positions in law enforcement or as expert witnesses, including McClelland, Sauber, Keep, and Reynolds. These individuals falsely claimed that the data represented “All” I2G gains and losses. This claim was incorrect for five main reasons:
- Data for 27 months, including 4000 entries and 4 million dollars, belonged to Xtg1 occurring I2G was closed.
- $28 million in commission payments to alleged victims was excluded from the Gains/Loss data.
- The Gains/Loss data did not deduct $600,000 in refunds issued
- The Gains/Losses data did not deduct $800,000 in auto-ship payments, which never occurred.
- Hundreds of “gifted” packages were inaccurately counted as “fully paid packages.” adding millions in inflated losses.
All these factors significantly inflated losses while concealing actual gains, resulting in false statements from 16 witnesses. Importantly, the government never corrected this data or the statements made by the witnesses.
The total commission earnings reported by the nine government witnesses were nearly $20,000 higher than what was presented to the jury in Exhibit 101i. In other words, the government obtained false testimony from each of these witnesses, inflating the losses presented to the jury by almost $20,000.
1.) Justin Moyer – 101i represented a false loss of $4852.00 even though he was fully refunded.
2.) Stephen Barnes 101i represented false gains of $28,000 instead of actual gains of $33,000. 101i represented a $5019.95 purchase that never occurred.
3.) Jeff Bennett- 101i represented false losses of $15,878.82. 7240 shows total commission earned of $4000 including $3000 in withdrawals. 101i misrepresented and inflated his loss by $4878.78
4.) Dino Aiello- 101i represented losses of $5154.21 despite his only purchase being $5019.95 and admitting to receiving commissions of $182.36. 7240 data shows total commissions earned and utilized as $382.00. 101i inflated his losses by $516.26
5,) Erik Wiksten- 101i represented losses as $3453.05. 7240 Total commission earned and utilized reflect $1891.72. 101i inflated his losses by $324.82
6.) Jordan Adams- 101i reflected losses of $4825.33 and earnings of $211.61. Adams testified he received $1000. 101i inflated his loss by at least $825.33
