Rick Maike, associated with Infinity Two Global, filed his appeal brief one year after his co-defendants, Hosseinipour and Barnes. Maike ultimately hired Kyle Singhal of Hophood & Singhal LLC, who is a Professorial Lecturer in Law at George Washington University Law School.

Rick Maike’s appeal brief, submitted by Kyle Singhal, primarily relied on the same appeal issues presented by Hosseinipour and Barnes, as outlined by their attorney, Kenyon Meyer from Dinsmore & Shohl LLP. The trial of Infinity Two Global was overseen by Chief District Judge Greg N. Stivers of Western Kentucky. Judge Stivers determined that an objection raised by one defendant applied to all, which meant that Hosseinipour had appealable issues that she would not have had otherwise, except through this ruling. Hosseinipour’s trial attorney, due to a lack of knowledge regarding court procedures and failure to make necessary objections, would have left her with no preservable trial issues besides a claim of ineffective assistance.

Kenyon Meyer of Dinsmore and Shohl LLP served as Doyce Barnes’s trial attorney. After the trial, Hosseinipour decided to hire Meyer for her appeal because of his in-depth understanding of the issues that arose during the trial. After thoroughly reviewing the I2G data, she concluded that Meyer was the only attorney capable of grasping the extensive prosecutorial misconduct related to the misleading data representations concerning 16 witnesses. Hosseinipour collaborated closely with Meyer and her team at Dinsmore to analyze the transcripts and develop their arguments.

Maike’s attorney filed a motion to consolidate his appeal brief with those of Hosseinipour and Barnes. However, Hosseinipour was concerned about being unfairly prejudiced by being directly associated with Maike once again. Meyer objected to this consolidation. Despite these concerns, the 6th Circuit Court granted Maike’s motion, allowing his arguments to be consolidated with those of his co-defendants. Consequently, Kyle Singhal was permitted to fast-track Maike’s appeal arguments and to appear alongside Kenyon Meyer at the scheduled oral arguments on December 11, 2024. Hosseinipour attended the oral arguments before the 6th Circuit’s Chief Honorable Judges: David W. McKeague, Raymond M. Kethledge, and John B. Nalbandian.

Judge David McKeague was appointed by George W. Bush on June 10, 2005. Judge Raymond M. Kethledge was appointed by Bush in 2007, while Judge John B. Nalbandian was appointed by Donald Trump in 2018. This panel of judges is known for their strong constitutionalist views.

The appeal attorney for the government was Tyler An Lee, a graduate of Columbia Law School. Lee, whether knowingly or unknowingly, continued to present the false data representations from the I2G trial and the opinions of William Keep as the basis for her evidence.
